Terms of Service

Effective: June 30, 2026

These Terms of Service ("Terms") are a binding agreement between you and RideGY Inc. ("RideGY", "we", "us", "our") and govern your access to and use of the RideGY mobile applications, website, and related services (together, the "Service"). By creating an account, tapping "I agree," or using the Service, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Your account

  • You are responsible for maintaining the confidentiality of your account and for all activity under it.
  • One account per person. You may not share, sell, or transfer your account, or impersonate anyone.
  • Keep your profile, phone number, and (for drivers) documents current. We may verify your identity and information.
  • Notify us promptly of any unauthorized use of your account.

3. What RideGY is

RideGY is a technology platform that connects riders who seek transportation with independent drivers who provide it. RideGY is not a transportation carrier and does not provide transportation services. Drivers are independent contractors; they are not employees, agents, partners, or joint venturers of RideGY. RideGY does not control, direct, or supervise drivers' operation of their vehicles, and is not responsible for the acts or omissions of any rider or driver.

4. Requesting and taking trips

  • You will see an estimated fare before you request a trip. The final fare may differ based on the actual route, distance, time, stops, waiting, tolls, and demand.
  • When you request a trip we attempt to match you with a nearby available driver; a match is not guaranteed.
  • Trips may use PIN verification at pickup. Do not start a trip with a driver who cannot confirm your details.
  • You are responsible for the conduct of anyone who travels with you and for any items you bring.

5. Fares, surcharges, and fees

  • Fares are quoted and charged in Guyana dollars (GYD). Pricing may include base/per-distance components, demand (surge) pricing, applicable surcharges (e.g., cross-river), and a booking fee where shown.
  • Cancellation and no-show fees may apply where a trip is cancelled after a driver has been matched or where a driver waits beyond a reasonable time, as disclosed in the app.
  • Tips are voluntary, go 100% to the driver, and are not part of RideGY's fees.
  • Charter / hire bookings, where offered, are subject to the rates, booking fee, and commission shown at booking.

6. Payments, refunds, and chargebacks

  • Depending on availability, you may pay by cash, mobile money (MMG), card, or a stored RideGY balance. You authorize RideGY and its payment processors to charge your selected method for the trips and fees you incur.
  • Card and mobile-money payments are processed by third-party providers subject to their own terms; we are not responsible for their acts or omissions.
  • RideGY credits, promotional balances, and loyalty rewards (e.g., "Miles") have no cash value, are non-transferable and non-refundable, may expire, and may be revoked for abuse.
  • Refunds, where granted, are at RideGY's reasonable discretion or as required by law. If you initiate a chargeback or payment reversal that we determine is improper, we may suspend your account and recover the amount owed.
  • You are responsible for any third-party fees (e.g., mobile-money charges) associated with your payment method.

7. Rider responsibilities

  • Comply with all applicable laws and these Terms, and treat drivers, their vehicles, and other users with respect.
  • Provide an accurate pickup and destination, be ready at pickup, and wear a seatbelt (and a helmet where a two-wheeled vehicle is used).
  • Do not damage vehicles, carry prohibited or dangerous items, or ask a driver to break the law.
  • Pay for the trips you take using a valid payment method.

8. Driver terms

  • Drivers are independent contractors and are solely responsible for compliance with all applicable laws, including licensing, permits, registration, roadworthiness, vehicle safety, and insurance appropriate to carrying passengers for hire.
  • You must pass RideGY's review and keep your information and documents current before and while going online. We may suspend access if requirements lapse.
  • RideGY charges a service commission on completed fares; the rate depends on your plan and is shown in the app. Driver earnings are settled via the methods and schedule shown in the app.
  • You are solely responsible for all taxes, contributions, and filings on your earnings. RideGY does not withhold taxes on your behalf.
  • You may decline or cancel requests subject to the cancellation policy and may be removed for poor service, safety issues, or policy violations.

9. Safety and emergencies

The Service offers safety tools such as PIN-verified pickups, the ability to share your trip, two-way ratings, and in-app reporting. These tools help but do not guarantee your safety. Always use good judgment. In an emergency, contact local emergency services (911) first.

Trip audio recording. To improve safety and help resolve disputes, the Service may offer an in-trip audio recording feature. Where this feature is enabled and turned on, audio inside the vehicle may be recorded during a trip. By using the Service as a rider or a driver, you acknowledge and consent to the recording of audio during trips when this feature is active, and you agree to make others travelling with you aware that the trip may be recorded. Recordings are intended solely for safety, security, dispute resolution, and legal-compliance purposes. They are stored securely, are not routinely monitored or listened to, and a recording is reviewed only when it is submitted together with a safety report or complaint, or where required or permitted by law. RideGY does not sell recordings and does not use them for advertising. This feature operates subject to applicable law, and how recordings are handled is further described in our Privacy Policy.

10. Assumption of risk

You understand that transportation is provided by independent third parties and that travel carries inherent risks. To the maximum extent permitted by law, you use the Service and accept rides at your own risk.

11. Prohibited conduct

You agree not to, and not to help anyone else:

  • Use the Service for any unlawful, fraudulent, harmful, or deceptive purpose, or to evade fees.
  • Harass, threaten, discriminate against, endanger, or harm any user, driver, or third party, or carry weapons.
  • Create accounts with false information, impersonate others, or operate more than one account.
  • Submit false reports or ratings, or manipulate the matching, pricing, or rewards systems.
  • Interfere with, disrupt, scrape, reverse-engineer, or attempt to gain unauthorized access to the Service.

12. Ratings, reports, and your content

You may submit ratings, reports, messages, and other content. You must keep it honest, lawful, and respectful. You grant RideGY a non-exclusive, worldwide, royalty-free license to use, store, and display such content to operate, improve, and protect the Service. You are responsible for the content you submit.

13. Intellectual property

The Service, including the RideGY apps, brand, logos, and content, is owned by RideGY or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended personal purpose. You may not use RideGY's names or marks without our written permission.

14. Third-party services

The Service relies on third parties such as maps, payment processors, and mobile-money providers. Your use of those services may be subject to their own terms, and RideGY is not responsible for third-party services or for the acts or omissions of riders, drivers, or other third parties.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or available at all times, or that any driver or rider is suitable, reliable, or safe.

16. Limitation of liability

To the maximum extent permitted by law, RideGY and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, personal injury, or property damage, arising out of or relating to your use of (or inability to use) the Service or any trip, even if advised of the possibility. To the extent liability cannot be excluded, RideGY's total aggregate liability arising out of or relating to the Service is limited to the greater of the total fees you paid to RideGY in the three (3) months before the event giving rise to the claim, or five thousand Guyana dollars (GYD 5,000).

17. Indemnification

You agree to indemnify and hold harmless RideGY and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your trips, your content, or your violation of these Terms or of any law or the rights of any third party.

18. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, create risk or legal exposure, or for any conduct we reasonably believe is harmful to other users, drivers, third parties, or RideGY. You may stop using the Service at any time and may request deletion of your account from within the app. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, and indemnification) survive.

19. Changes to the Service and to these Terms

We may modify or discontinue parts of the Service at any time. We may also update these Terms; when we make material changes, we will revise the "Effective" date below and you will be asked to accept the updated Terms in the app before continuing to use it. Your acceptance, or your continued use after the changes take effect, means you agree to the updated Terms.

20. Governing law and dispute resolution

These Terms are governed by the laws of the Co-operative Republic of Guyana, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us at [email protected] and try in good faith to resolve the dispute informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Guyana.

21. General

  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
  • Severability: if any provision is held unenforceable, the rest remain in effect.
  • Assignment: you may not assign these Terms; we may assign them to an affiliate or successor.
  • No waiver: our failure to enforce a provision is not a waiver of it.
  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and RideGY regarding the Service.
